論音樂(lè)作品的著作財(cái)產(chǎn)權(quán)保護(hù)

摘 要：音樂(lè)作品主要被以廣播、表演以及網(wǎng)絡(luò)傳播的方式使用，因此音樂(lè)作品的廣播權(quán)、表演權(quán)以及網(wǎng)絡(luò)傳播權(quán)是著作權(quán)人主要的、極易受侵害的財(cái)產(chǎn)權(quán)利?，F(xiàn)今社會(huì)大量存在著廣播、電視中無(wú)償使用音樂(lè)作品的問(wèn)題；營(yíng)業(yè)性場(chǎng)所的機(jī)械表演問(wèn)題；以及網(wǎng)絡(luò)音樂(lè)免費(fèi)傳播的問(wèn)題。我國(guó)現(xiàn)行著作權(quán)法對(duì)音樂(lè)作品財(cái)產(chǎn)權(quán)的保護(hù)尚不完善，因此要繼續(xù)規(guī)范著作權(quán)的法定許可和合理使用制度，完善著作權(quán)集體管理制度和網(wǎng)絡(luò)傳播制度，切實(shí)加強(qiáng)對(duì)音樂(lè)作品的保護(hù)。

Abstract: Musical composition primarily used by broadcast、performance and network communication, so the right to broadcast musical works、performing rights and the right of network communication is a major and vulnerable to violations of property rights. Nowadays there are a lot of question about free use in radio and television; place of business of the mechanical performance issues; and the problem of the spread of online music for free. China's current copyright laws protect the property rights of music is not perfect, so to continue to regulate the statutory copyright license and the rational use of the system, improve the system of collective management of copyright and the network communication system and strengthen the protection of musical works.
